“Customer”: The exporter or importer or person or organization (including its subsidiaries) entering into this Agreement by accepting the terms & conditions and authorizing the Freight Operator(s) who also works with The Company for website online booking facilities. Hereinafter also referred to as “You”.
“Freight Operator”: Any individual or organization (including its subsidiaries) appointed by The Company and hereby authorized to use any or all the information provided in order to complete the shipment to designated location.
“The Company”: Less To Load Logistics Sdn Bhd (ROC Registration Number 1005662-M), a Private Limited Company incorporated in Malaysia under the provisions of The Companies Act, Act Number 125 of 1965, with an office at Number 115-C, Jalan Tengku Badar, 42000 Port Klang, Selangor, Malaysia. Hereinafter also referred to as “Us” or “We”.
“LCL” “Less than Container Load”: A low cost facility provided by The Company for the Customer to buy space in units in a Container.
1. Service Scope
The services offered by The Company via website are as follow:
01.01 LCL container space in the following service options: a. Door to Port; b. Port to Door; c. Port to Port, & d. Door to Door
01.02 Online booking and Payment Facilities;
01.03 Online invoice self-verification;
01.04 Online shipping documentations to expedite process;
01.05 Online systems to view, and track Shipment Details;
01.06 The Company will not accept any Hazardous, Perishable or Categorized Dangerous Goods for shipping;
01.07 The Company does not provide packing service. Boxes, packing tape and other shipping supplies can be purchased on-line via packaging partner of the web-site at Customer’s own cost, if any.
01.08 The Company does not insist on compulsory pick-up or delivery service and the Customer can use their own transportation means to deliver the shipment to the The Company’s designated warehouse Provided That the delivery is made at specific times and specific days before container loading dates And Further Provided That The Company will not be held responsible for missed shipment due to late self-delivery to warehouse And It Is To Be Noted That The Company will not accept late self-delivery.
01.09 The Company does not provide inside pickup/delivery service. Loading/Unloading of boxes/crates accepted for Door to Door service is limited to pick-up/unloading at the front door/gate on ground floor level only.
01.10 Sunday & Public Holidays pickup is not available.
2. General Conditions
02.01. All rates & service conditions published here online are subject to changes without notice and subject to The Company's prior decision, agreement and booking conditions.
02.02. The Company does not guarantee a specific transit time for sea freight as sailing times and vessel schedules is not precise. The website is merely providing the best estimating departure dates to allow advance booking.
02.03. Delay of vessel/sailing time can be caused by uncontrollable and/or unforeseeable factors like (but not limited to) engine breakdown(s), natural disaster(s), accident(s), strike, strife, civil disobedience, war, hijackings, Act of God, etcetera And in any such event(s), The Company will not be held responsible for any delay of shipment. The Company will in such an event endeavor to make the shipment in the next available LCL slot and if no suitable slot is available, the Company has the option to return the shipment to the Customer and after deduction of all interim costs incurred, refund the fees paid to the Customer.
02.04. The Customer must ensure that all goods for shipment are well packed or crated so The Company can duly record and label every single box in order to ensure good safety in transit & storage.
02.05 The Customer must provide accurate information as to the size, measurements and weight of the boxes and crates for shipping so an accurate invoice may be generated. Additional charges and penalties in line with Clause 6 below may be applied by The Company if the invoice generated is based on inaccurate information provided by the Customer.
02.06. All high value, fragile and other special cargo must be declared to The Company to enable The Company to make suitable arrangements for receiving same. Any loss or damage arising from non declaration shall be at The Customer's own risk.
02.07. The Customer must provide true and accurate answers to all the information needed such as (but not limited to) Sender Information, Consignee Information, Good Description & Declaration Value for shipping & delivery purposes. Inaccurate information provided will be at The Customer's own risk and expense.
3. Booking with The Company
03.01. The Customer must quote & schedule their shipment on-line with guidance steps provided by The Company via website. Any failure to follow the booking instructions may result in shipment cancellation, delay or additional charges being applied.
03.02. The Company will not be responsible for any problems which may occur from the transaction due to network provider line instability.
03.03. The Customer will receive confirmation of booking after completion of all forms and redirected to documentation section for registration.
4. Relevant Documents
04.01. Upon completion of payment, the Customer will redirect to a link for filing all essential shipping documents necessary to complete the entire shipment.
04.02. The Customer is solely responsible to submit accurate and complete shipping documents and The Company will not be responsible for insufficiency of documents represented to all relevant parties related to a shipment. The Customer hereby expressly acknowledges and agrees that any failure by The Customer to fully and properly complete the necessary documentation may result in the shipment’s cancellation or delay and may cause other charges like warehouse, transportation charges and or other penalties to also be applied.
04.03. It is the Customer’s sole responsibility to have the proper documentation prepared for export and import custom clearance and to comply with the laws and requirements of countries of destination.
5. Insurance Coverage Information
05.01. All Customers are advised and encouraged to include full insurance coverage on their goods/shipment valued more than Ringgit Malaysia One Thousand Only (RM1, 000.00). Option of insurance purchase is available during booking session.
05.02. The Company will not under any circumstances be held responsible if The Customer opts not to purchase the Insurance coverage.
05.03. The Customer agrees that The Company’s is limited to direct loss only and all other types of loss and damage are excluded (including but not limited to loss of profits, income interest or future business) whether such loss is special or indirect and even if the risk of such loss or damage is brought to the attention of The Company before or after acceptance of shipment since special risks can be insured by the Customer.
05.04. The Customer agrees that The Company’s liability in respect of any one Shipment is limited to its actual net value of the Goods or Ringgit Malaysia One Hundred per cubic meter /per (m3), whichever is the lower.
05.05. The Customer is strongly advised to and required to include insurance coverage on their goods for shipment for all points of shipment.
05.06. All claims if any must be submitted to The Company within three (3) days from the date when The Company accepted the shipment. All claims will be void after this period.
6. Payment Conditions, Price Rates & Oversize/Overweight Charges
06.01. The Company accepts major credit cards online Pay on-line using Visa & Master Card.
06.02. The Company also accepts money transfer facilities to its bank account enlisted in the payment session. Important NOTICE: If payment is not received with 48 hours after booking, then the booking will be automatically cancelled without prior notice.
06.03. For early bookings, The Company also accepts cheques payable to “Less To Load Logistics Sdn Bhd” on the express condition that clearance of all payments must be received in full by The Company six (6) full working days before the sailing date.
06.04. Minimum booking price rate will be charged for any booking size is less than one (1) m3 subject to the price rate display online.
06.05. The Company is not charging weight below 500kg per 1m3. Every additional kilogramme will incur additional charges of RM1/- per kg.
06.06. The Company is charging for actual size declared. Every additional cubic metre will incur additional charges of Ringgit Malaysia One Hundred and Twenty Only per cubic meter (RM120.00 per m3) if measurements are found different from actual size declared in the booking details.
06.07. Upon receiving the original boxes or crates, The Company’s Warehouse Station will certify the actual weight-measurement and size-measurement as declared by the Customer against the item presented.
06.08. The Company reserves the right to reject the shipment if the box/crate exceeds the declared size and weight by 5%.
06.09. Any box/crate which exceeds the declared weight and size by 5% will attract penalty of Ringgit Malaysia One Hundred Only (RM100.00) over and above all other additional charges attracted for extra weight and size.
06.10. The Company will issue an off-line invoice for the additional charges incurred and payment must be settled in full 5 working days before the estimated sail date failing which the shipment will not be loaded and the Customer will be liable to additional demurrage and other charges.
7. Bill of Lading/ Consignment Note
07.01. Upon completion of booking, all information of shipment will be automatically made available in the pre-confirmed Bill of Lading/ Consignment Note via this website.
07.02. The Customer must final amendments and checking of details of BOOKING before confirmation. The Customer undertakes to indemnify The Company and hold it harmless against all claims whatsoever that may be made against The Company for inaccurate or wrong information provided by The Customer.
07.03. After shipment departure, Telex-Release Bill of Lading/consignment note will be e-mailed/downloadable via website to the consigner/Customer. Mail or facsimile copies are available upon request.
07.04. Consignee may contact the receiving station on the Estimated Time of Arrival (ETA) of the consignment.
07.05. Bill of Lading/Consignment Note Cancellation might occur if final payment via bank transfers or cheque clearance fails to occur for any reason whatsoever and The Company reserves the right to cancel the Bill of Lading via telex-release at the destination. In such event, The Customer will have to provide the original Bill of Lading over which the Company has a Lien to recover the shipment at destination. The original Bill of Lading/ Consignment Note will be released by The Company to the Customer after payment of all costs and charges.
8. Type of Destination Services
8.1 Customers Own Charges at Destination on Door to Port Service Selected
08.01. The following charges are not included in The Company’s booking websites invoices and must be paid by The Customer/Consignee directly at the destination receiving terminal.
08.02. Destination charges may include but are not limited to the destination country’s customs duty, tax, VAT (value added tax), reloading, terminal handling charges, shipping documentation, custom forms filing etc.
08.03. The Customer/Consignee must clear its shipment through customs at the designated port of entry assigned by the carrier. It is the responsibility of the customer/consignee to arrange customs clearance.
8.2 Customer’s Own Charges at Destination on Door to Door Service Selected
08.01. All destination charges are included in The Company’s booking website invoice where The Customer pays on behalf of the consignee to allow cargo release at the destination terminal.
08.02. The transporter appointed by The Company will handle the customs clearance at destination and arrange for delivery to the consignee’s door/gate at ground floor level.
08.03. Additional charges will be applied by transporter to consignee if deliveries are request at 2nd floor onwards.
8.3 Customer’s own charges at Selection of Self-delivery either to Company’s Warehouse or Consignee destination.
08.01. Customer to choose The Company for Port to Port Service only, Choice of self-delivery will incur own charges which are borne fully by Customer and Customer has to assign their own transporter/forwarders to handle pick up/delivery and customs clearance at destination.
9. Copy Right & Trademarks
09.01. The title and copyright © Less to Load Online service and related intellectual property rights are the property of the companies in the Less to Load Logistics Sdn Bhd group or other specifically indicated parties. All rights are reserved in countries.
09.02. The data provided in the online service may be copied, stored, or printed for internal reference only.
09.03. Consequently, the publication, reproduction, transfer, storage or commercial use of the content of the online service or part thereof without the owner’s permission is forbidden for purpose other than those specified herein.
09.04. The online service web pages may not be linked to other services without written consent and approval from The Company.
